Our client, the Arlington Club, had received an ECB violation that alleged that their air conditioning equipment had exceeded the noise code limits. The club appeared at the hearing without an attorney, represented only by the club's managing partner and Alan Fierstein of Acoustilog. Mr. Fierstein presented evidence that the ECB inspector's measurement was made improperly - specifically, that the ECB meter was overdue for its mandatory calibration and that the measurement was taken under high wind conditions that are known to contaminate noise readings. The Judge credited Mr. Fierstein's testimony and dismissed the violation with no penalty.

Based on the foregoing, I find that the readings taken by petitioner at the time of issuance with the meter that had not been calibrated up to date were questionable and therefore, do not substantiate the charge. Accordingly, this NOV is dismissed.
