Noise Case: 57 Jay Owner v. Round of Appaws d/b/a Hounds Town USA

Whose "side" are we on?

Civil Court of the City of New York
L&T Index #327483-23/KI
Judge Delsia G. Marshall

Alan Fierstein recently testified in a case involving a dog care facility which violated the Noise Code Section 24-235 for unreasonable dog barking noise.

In addition to presenting his findings, he played calibrated recordings of the barking so the judge could accurately experience the noise inside the residential tenant's apartment, at the same level as they hear it. This makes for a much more effective presentation than dry numbers and graphs on a page.

The judge agreed that the noise was unreasonable and ordered the eviction of the commercial dog care facility. The residents will be able to enjoy their apartment in peace.
